Nagpur, Maharashtra | September 5, 2026: The Supreme Court has refused to interfere with a Bombay High Court ruling upholding the acquisition of 12.12 hectares of land in Nagpur for a sewerage treatment plant (STP) and pumping station.

The decision removes a major legal hurdle for the civic infrastructure project under the state-funded Pohra River Pollution Abatement Project, while allowing the affected builder to continue pursuing its claim for higher compensation.


Supreme Court Upholds Land Acquisition for STP

A bench of Justices Dipankar Datta and Sheel Nagu dismissed the special leave petition filed by Shree Ganesh Builders against the Bombay High Court's August 7 judgment.

The land at Mouza Chikhli (Khurd) has been reserved since Nagpur's 2001 Development Plan for a drainage and sewerage disposal scheme. The acquisition award was passed on October 29, 2025.


Builder Had Challenged the Reservation and Acquisition

The builder argued that the reservation had lapsed under Section 127 of the Maharashtra Regional and Town Planning Act (MRTP Act).

The Bombay High Court rejected the argument, finding a fundamental defect in the purchase notice issued by the builder in June 2014. The notice covered three land parcels whose revenue records listed different legal entities as owners.

The Nagpur Municipal Corporation had pointed out the discrepancy in December 2014 and sought title documents, but the defect was not rectified.

 


High Court Also Considered the Builder's Conduct

The High Court noted that acquisition proceedings began in 2025 and that the builder participated in hearings and submitted compensation claims. It subsequently sought enhanced compensation through a reference.

The court found this conduct inconsistent with simultaneously challenging the acquisition itself and upheld the award.


₹11.77 Crore Compensation Already Deposited

According to the High Court order, ₹11.77 crore had been deposited with the Land Acquisition Officer as compensation.

The Supreme Court has not closed the builder's compensation-related remedies. It has specifically left it open for the builder to pursue its claims for higher compensation before the appropriate authority.


Nagpur Sewerage Infrastructure Gets a Clearer Path

The acquired land is intended for an STP and pumping station under the Pohra River Pollution Abatement Project. The project aims to reduce pressure on Nagpur's existing sewage-treatment infrastructure and improve capacity as the city's population grows.

The project had remained stalled while the legal dispute was pending and an interim status quo order was in place. With the acquisition challenge dismissed, construction can now move forward subject to the remaining project requirements.
