Odisha Moves to Restore ORERA Bench as Pending Homebuyer Cases Remain in Focus

BHUBANESWAR | July 27, 2026: The Odisha government has initiated the process of appointing a new member to the Odisha Real Estate Regulatory Authority (ORERA), a move that could help strengthen the state's real estate dispute resolution system at a time when homebuyer complaints and regulatory matters continue to require timely hearings.

The appointment process has begun following a vacancy on the ORERA bench, while another important position—the Chairperson of the Odisha Real Estate Appellate Tribunal (OREAT)—also remains unfilled.

Vacancies Raise Concerns Over Case Disposal

ORERA is responsible for hearing matters related to project registrations, regulatory compliance, developer obligations and complaints filed by homebuyers under the Real Estate (Regulation and Development) Act, 2016.

With key positions remaining vacant, stakeholders have expressed concern that the pace of hearings and disposal of pending cases could be affected if appointments are delayed further.

A fully functional regulatory body is considered essential for ensuring timely decisions in disputes involving residential projects.

Government Begins Appointment Process

According to official sources, the state government has started the selection process to fill the vacant administrative member's position and restore the authority to its full working strength.

The move comes as ORERA continues to handle applications from developers alongside complaints filed by property buyers across Odisha.

Industry observers believe completing the appointment process without unnecessary delay will help improve administrative efficiency.

Real Estate Sector Seeks Institutional Stability

Legal experts and housing sector stakeholders have emphasised that regulators and appellate bodies play a critical role in maintaining confidence in the property market.

They believe prolonged vacancies can create uncertainty for both homebuyers awaiting decisions and developers seeking regulatory approvals or dispute resolution.

A stable regulatory framework is considered important for maintaining transparency and accountability in the real estate sector.

Staffing Challenges Have Surfaced Before

This is not the first time ORERA has faced staffing issues.

Similar concerns arose earlier when multiple senior positions became vacant within a short period, prompting discussions about the regulator's ability to continue functioning efficiently until new appointments were made.

The latest recruitment process is expected to help address one of those vacancies, although stakeholders are also awaiting the appointment of the appellate tribunal's chairperson.

What This Means for Homebuyers

Homebuyers with pending matters before ORERA may closely watch how quickly vacant positions are filled, as a fully staffed regulator is generally better equipped to process complaints and conduct hearings efficiently.

Faster appointments can also improve confidence among buyers who rely on the authority for resolving disputes related to housing projects.

Why This Matters

Real estate regulators are a key pillar of consumer protection in the housing sector. Ensuring that bodies such as ORERA and OREAT function at full strength is important for timely dispute resolution, regulatory oversight and maintaining trust among both homebuyers and developers.
