GURUGRAM | July 28, 2026: The Haryana Real Estate Regulatory Authority (HRERA) has once again reinforced the legal rights of homebuyers by directing developers to compensate purchasers for delays in handing over residential units. The latest rulings make it clear that developers may remain liable for financial losses caused by delayed possession, even if buyers have already received refunds or interest under previous orders.
The decisions were delivered in separate complaints involving residential projects in Gurugram, highlighting the regulator's continued focus on ensuring accountability in the housing sector.
HRERA Awards Compensation Beyond Refunds
In one case, the authority directed a developer to pay compensation to homebuyers who had waited years for possession before eventually withdrawing from the project.
The authority observed that merely refunding the deposited amount with applicable interest does not automatically compensate buyers for the financial impact of prolonged project delays. It noted that property values may appreciate significantly over time, resulting in additional losses for purchasers who are unable to take possession as originally promised.
The ruling recognises that delayed delivery can affect buyers beyond the amount they initially invested.

In another complaint, HRERA ruled that issuing an offer of possession does not necessarily mean a buyer has received a livable home.
The authority found that compensation could continue if the actual physical handover of the apartment occurred later than the date on which possession was formally offered.
According to the regulator, developers are expected to deliver homes that are genuinely ready for occupation, rather than relying solely on procedural milestones to conclude their obligations.
