Mumbai, Maharashtra | September 11, 2026: Thousands of Mumbai property owners could get a route to regularise long-pending Occupancy Certificates (OCs) after the Brihanmumbai Municipal Corporation rolled out an amnesty scheme covering around 20,000 buildings occupied before November 17, 2016.

The scheme is particularly significant for older residential properties where OC approvals have remained stuck because of documentation or procedural issues. BMC has also introduced financial concessions on several regularisation charges.


Which Properties Can Qualify

The scheme covers eligible residential buildings, hospitals and schools, with individual units generally subject to a carpet-area limit of 80 sq m.

Buildings must have an approved IOD and plans, development or construction permission under applicable BMC rules and a valid Commencement Certificate. Applicants will also need evidence showing that the building was occupied before November 17, 2016.


Owners Can Get Major Charge Concessions

Eligible applicants can receive a 50% reduction on certain regular charges, including revalidation fees, balcony-related charges and penalties for specified violations.

There is also a time-bound concession for converting certain approved non-FSI or elevation features into habitable residential space. Applications within six months can avoid the penalty, while applications submitted between six months and one year can receive a 50% reduction.

 


OC Approval Could Improve Property Position

For homeowners, obtaining an OC can make a property easier to sell, transfer, finance or redevelop, while reducing uncertainty around long-pending approvals.

The scheme also addresses issues such as missing Building Completion Certificates, incomplete layout infrastructure, pending tax clearances and drainage completion documentation that may have delayed OC issuance.


Amnesty Does Not Cover Unauthorised Construction

The scheme does not provide blanket legalisation for unauthorised construction. Cases pending before courts or the Anti-Corruption Bureau will require appropriate orders before an OC can be granted.

BMC will also publish proposals on its AutoDCR system, giving interested parties a 15-day window to raise objections or representations.

 


Partial OC Option Could Help Flat Owners

The guidelines also allow individual flat owners or occupants to seek a partial OC in eligible cases. Proportionate use of additional FSI, fungible compensatory area or TDR will be subject to prescribed limits.

For qualifying properties, the partial OC route could help owners move forward without waiting for every part of a larger building to be regularised. The scheme therefore offers a potentially important opportunity for older Mumbai properties, but owners will still need to meet the prescribed planning and legal conditions.
