UP RERA 4-Month Extension Sparks Dispute as CREDAI Seeks Wider Relief for Developers

Noida, August 28, 2026: Uttar Pradesh RERA’s decision to grant a four-month extension to eligible real estate projects has triggered a dispute with developers, with CREDAI Western UP arguing that the conditions attached to the relief could leave a large number of projects out.
The association, representing more than 400 developers in Western Uttar Pradesh, has asked UP RERA to withdraw or reconsider its August 21 order.
Why Developers Are Opposing the Order
CREDAI says the Centre’s July 31 advisory treated the disruption caused by the West Asia situation as a force majeure event and did not prescribe a specific cut-off date.
However, UP RERA has limited the extension to projects whose registered completion deadlines fall between February 28 and October 31, 2026.
CREDAI argues that this restriction substantially reduces the number of projects that can benefit from the four-month extension.
Other Conditions Could Further Reduce Eligibility
According to the developers’ body, additional requirements related to:
- Validity of approved building plans
- Submission of quarterly progress reports
- Payment of outstanding RERA penalties
could further prevent developers from accessing the relief.
CREDAI has also pointed out that RERA authorities in Maharashtra, Karnataka, Telangana, Tamil Nadu and Haryana have provided four-month extensions without similar additional conditions.
What UP RERA Has Actually Granted
UP RERA granted the four-month extension on August 25, 2026, citing disruptions to construction material supplies linked to the West Asia crisis.
Importantly, the extension applies to the project registration validity and stipulated completion period recorded with RERA. It does not change the contractual rights and obligations between homebuyers and developers under an existing Agreement for Sale.
What It Means for Homebuyers
For homebuyers, the dispute is important because any extension of a project's official completion timeline can affect possession expectations and project delivery schedules.
