Gurugram, September 2, 2026: A UK-based couple who have waited years for possession of their flat in Gurugram has received relief from the Haryana Real Estate Regulatory Authority (H-RERA), which has directed Identity Buildtech Pvt Ltd to pay 10.8% annual interest for the delay.

The couple had booked a flat in 2016 and later shifted their investment of more than Rs 48 lakh to a unit in Ansal Highland Park in Sector 103 in 2019. A fresh buyer agreement promised possession by November 30, 2021, but construction failed to make substantial progress.

Despite paying another Rs 18 lakh and meeting the developer's instalment demands, the buyers have still not received possession. The project also does not have an occupation certificate or a valid offer of possession.


H-RERA Rejects Builder's Limitation Plea

H-RERA rejected the developer's argument that the buyers' complaint was time-barred. The authority held that since the project has not received an occupation certificate, it remains an ongoing project and RERA provisions continue to apply.

The authority also directed the developer to pay interest from the promised possession date until a valid offer of possession is made or the flat is handed over.

 


What This Means for Gurugram Homebuyers

The order reinforces the protection available to homebuyers when developers fail to deliver possession within the agreed timeline. Buyers facing prolonged construction delays can approach RERA for relief instead of being limited to the terms of the original builder-buyer agreement.

H-RERA has directed Identity Buildtech to clear the accumulated interest within 90 days, followed by monthly interest payments by the 10th of each month.

The authority clarified that any separate claim for compensation relating to mental harassment or litigation expenses would have to be pursued before the adjudicating officer under Section 71 of the RERA Act.
