Booked a Flat, Paid in Full, Then Lost It to Another Buyer Court Orders Refund With Interest

MUMBAI | June 26, 2026: A Mumbai consumer commission has ordered two builders to refund more than 1 crore with interest after a homebuyer couple paid the full price for a flat but later discovered that the same property had been sold to another buyer.

The decision comes after the couple spent more than a decade pursuing justice following repeated delays, unfulfilled promises and failed refund commitments.

What Happened

The buyers initially booked a flat in one housing project and later agreed to shift to another project after construction failed to begin within the promised timeline.

Despite paying the full sale consideration, they later found that the allotted flat had already been sold to a third party.

According to the complaint, the builders assured a refund, but several cheques allegedly bounced before the matter reached the consumer commission.

Consumer Commission's Decision

The commission held that the builders had failed to deliver the promised home and directed them to refund the amount with interest.

It also awarded compensation for mental agony and litigation expenses, observing that the buyers had faced prolonged financial and emotional hardship.

Why This Matters for Homebuyers

The case highlights the importance of verifying project documents, maintaining payment records and seeking timely legal remedies if contractual commitments are not fulfilled.

Consumer forums continue to provide an important avenue for homebuyers facing disputes related to delayed possession, refunds and other service deficiencies.

What Buyers Can Learn

Before purchasing a property, buyers should:

  • Verify project approvals and legal documents.
  • Ensure all payment receipts and agreements are safely preserved.
  • Regularly monitor project progress.
  • Take prompt legal advice if serious contractual issues arise.

Final Takeaway

The ruling reinforces that homebuyers have legal remedies when builders fail to honour their commitments. It also serves as a reminder that transparency and compliance remain essential for maintaining trust in the real estate sector.
